From conformative authorization to enabling normative regimes. Towards new paradigms in the regulation of cultural heritage
Abstract
The essay highlights the shift from traditional conformative powers of authorization towards new, lighter form of regulations in the administration of the cultural heritage. The analysis is carried out on the three areas of free reproduction of cultural heritage, minor building interventions in areas subject to landscape constraints and international trade of artwork objects. This metamorphosis of public powers causes a meaningful evolution of the features of protection and enhancement of the cultural heritage.
