Abstract

mulinoThe essay investigates the various structures and purposes of the third sector organizations through the problem of both mere subjectivity and legal personality. The legislation of Civil Code regarding bodies and companies is compared with the one contained in the mosat recent and sectorial Third Sector Code in order to discover analogies and differences. At the same time the author examines the problem of the financial liability of this new kind of specific organizations and the related asset control techniques. An other involved aspect is the one of the relationship with the rules concerning the assets earmarked for a specific business. The conclusion of the autor is about the necessity to adequate the positive rules to a new conception of the organization, above all for their specific purpose of solidarity, not yet of business.
