Abstract
The paper aims to analyse the role that the Member States of the EU could – or, perhaps, should – have in the protection of the EU values. Particularly, among the instruments available, the paper considers those of judicial nature – that is, the infringement procedure of which at art. 259 TFEU and the inter-State appeal ex art. 273 TFEU – in order to understand their potentials for a more strategic application to react to the violation of values by other Member States.
