Abstract

The Author examines the European Court reasoning in the case of "Parrillo v. Italy" highlighting some ambiguity in the Court's reasoning about the embryo's status in relation with the woman autonomy. Then the Author expresses some critical comments on the concept and use of the national margin of appreciation, underlining the autonomy of the Constitutional Court judgement which is due soon about the Italian prohibition of the use of embryo for scientific purpose.
