The judiciary and the Statuto Albertino in the Kingdom of Sardinia: balance of powers or supremacy of politics?

Abstract

Based on the analysis of the Statuto Albertino, the article attempts to reconstruct the passage from an Ancien Régime judiciary to a judiciary based on the codes and constitution in the Kingdom of Sardinia. The conflict between judiciary and legal profession, an expression of class conflict between the aristocracy and the bourgeoisie, is also investigated. After a failed attempt to find a compromise in order to preserve the privileges of the high courts judges (especially the rule which prohibited transfers without consent), the relationship between politics and the judiciary assumed the characteristics that it would keep in the unified Italy after the Urbano Rattazzi laws.
