Abstract
The essay discusses Habermas' defense of cosmopolitic rights. Using Carl Schmitt's categories and the principles of political realism, the authour shows the limits of Habermas's idea of human rights as legal rights and not simply as moral rights. The impossibility for Habermas to find a solution to the difficult relationship between the moral and juridical dimensions of human rights, proves that the theory of human rights is an ideology, legitimating - ex-post - global american politics.
