Abstract
Critical analysis of the judgement of the Italian Constitutional Court which assessed the constitutional legitimacy of the so called «Decreto Alitalia» (suspending, for a limited lapse of time, the enforceability of the general merger discipline in order to accomodate the concentration of the formerly state-owned air carrier, Alitalia, and the second player in the domestic market, AirOne).
