Abstract

The focus of this paper is on the litigation related to the nazi and fascist crimes of WW2, which has led to landmark decisions by Italian courts. This is regarded as a case study capable of enlightening the general problem of tort liability for historical injustices, a phenomenon which will be analyzed from a comparative perspective in order to better understand its premises and consequences for contemporary law.
