Abstract
In analyzing Giovanni Tarello’s Introductory Lectures on the constitutional discipline of property, some theoretical-methodological tenets of Tarello’s approach (such as the critique of conceptualism) are highlighted and examined, exploring the significant links between this approach and the methodological heritage of American legal realism. Of particular importance in this context is the influence of the work of jurists such as Arnold, Cohen and Llewellyn, acutely investigated by Tarello.
