Abstract
The paper aims at showing that an ancient Festus' passage, read in the perspective "de iure publico", within the context of the palingenesis of the earliest Roman written law, provides arguments to the Eighteenth century debate on the origins of civil institutions, feudalism and the questioning of legal statuses.
