Abstract
The paper aims at reconstructing, in an analytical way, the argumentative path through which the Ecuadorian Constitutional Court introduced same-sex marriages in the country, despite the national Constitution provided that marriage is between a man and a woman. The elucidation and full understanding of the logical steps underlying the decision are also interesting in the light of litigation strategies which are found in other countries.
