Abstract

The paper aims at proposing a specific definition of climate change litigation, assuming as starting point the publication of the Global Climate Litigation Report. Furthermore the paper highlights the link between climate change litigation and the more general phenomenon of strategic litigation. In doing so, the paper intends to put in evidence the particular conditions that favour the «boom» in climate change litigation, questioning the role that climate change litigation can play in the transnational governance aimed at countering anthropogenic climate change.
