Abstract

The essay refers to the study of private autonomy in the perspective of the so-called libertarian paternalism that originates from the acquisition of behavioural economics, to overcome the traditional model of homo oeconomicus, highlighting the importance of the so-called «nudge», in general, and of default rules, in particular.
