Can the judgement cappato be called «historical»?

Abstract

In the author’s opinion, with decisions n. 207/2018 and n. 242/2019, the Italian Constitutional Court has produced a «historic» turning point in its own jurisprudence, not only for the originality of the solution of the decision adopted, but also and above all for the important jurisprudential perspectives that could open up. Although in the future, the jurisprudence of the Constitutional Court could have an attitude of self-restraint, however the decision n. 242/2019 certainly has a «historical» significance.
