Abstract
The article describes the historical discussions about the opinion that Hans Kelsen, by request of a Brazilian journal, expressed concerning the decree that regulated the National Constituent Assembly of 1933-1934. Major legal and political themes of the period are discussed by illustrating the context of the Brazilian publication of the Austrian author.
