Abstract

Building on the legal pluralism theory formulated by Santi Romano, the article analyses the institutional structure and the «case law» of the Oversight Board (OB), a quasi-judicial dispute-settlement body set up by Meta in order to review content moderation decisions on its platforms. To this purpose, the article separately analyses the rules related to the institutional structure and then those, both procedural and substantive, applied by the OB in its decisions. In the light of such inductive analysis, the article provides some concluding remarks concerning the potential role played by the OB in the constitutionalisation of digital spaces.
