Abstract
In Spanish law, the influence of case law on the pracitcal enjoyment of religious freedom has been observable in many contexts. This influence has not always been linear, as it has had both positive and negative effects. The courts have sometimes acted as a brake on the evolution of the system, at other times they have sought a balance between respect for tradition and new social challenges, and there have been cases in which they have brought about a change in the conception of legal structures to promote the recognition of freedom and equality.
