Abstract
The Lisbon Treaty has strengthened the weight of non-discrimination and equal treatment without distinction of religion or belief. Among the general principles of EU law resulting from the ECHR, as interpreted by the Strasbourg Court, it's confirmed the leading role of the principle of proportionality. The ethics organizations can request that the religion or belief are a professional requirement, provided it is genuine, legitimate and justified, but also proportionate to the nature of the employee's activities.
