«Best interest of the child» and inviolable right to education between budget constraints and social inclusion

Abstract
The present essay examines the delicate relationship between financial laws and the inviolable right to education, taking as a basis the recent ruling of the Constitutional Court n. 275/2016. According to such a decision, given the fundamental character of the right to education, it cannot be injured, in his essential core, neither by the legislator's discretion, nor by spending review needs, but a balancing with other values has to be operated case by case. For this purpose, the Author develops, in particular, the complex contents of the right to education whose inclusive character has been completely recognized by the recent both italian and international jurisprudence.
