Abstract
Rights and obligations deriving from employment contract may collide with the right to religious freedom and non-discrimination. Therefore, these fundamental rights must be reconciled with the power of business organization and contractual obligations under the employment contract. In this study we have analyzed the first judgments issued by the ECJ regarding religious freedom and non-discrimination under the employment contract.
