Abstract
The article addresses the issue of the relationship between employer powers and employee identity, having particular regard to the Court of Justice of the European Union case law on the prohibition of discrimination and neutrality policies. It offers a critical reading of the Court’s decisions, reflects on their systemic implications, and on the possible responses that classic labour law protection techniques might offer to issues raised by the growing religious pluralism of contemporary European society
