Abstract

The key to reading this essay is the central position and priority of the safety execution over the compensation for damages which is residual. The study has regarded the following themes: a) one must realize that compensation for damages isn't able to assure the personal protection in employment contract; b) one must re-examine, with a critical eye, the personal damage in the labour contract, in the light of the function which the recent jurisprudential and dogmatic elaboration attributes it; c) our legal system doesn't oppose, neither logically or juridically, to recognize the right to ask for execution and even forced performance of safety obligation which the employer has to meet.
