Abstract

The authors analyse the subject of equal opportunities in the Italian judiciary in the framework of constitutional principles and ordinary rules, including some suggestions from comparative studies. The essay takes into account statistical data, which clearly show a substantial increase in women's presence in the judiciary. Therefore problems concerning measures aimed at promoting/assuring equal opportunities in judicial offices organization, in the statutory rules on judges' career, in the election systems of judges' self-government institutions and associations can be easily set out from an objective point of view. In its final part, the analysis deals with the European Project on equal access to decision-making positions in the judiciary - promoted by the Italian High Council for the Judiciary ("Consiglio Superiore della Magistratura") with the support of the European institutions - describing both the research carried out and the conclusions it came to.
