Conciliation and support measures. About the positive actions ruled by art 9 of Act n. 53/2000

Abstract

The universally shared goal of conciliation between professional and family life, does not always imply the same valuation of the involved interests and of the number of issues related to the equality principle. Art. 9 of Act n. 53/2000, has provided for a public support to positive actions aimed at conciliation and planned by collective agreements. The author, even if she individuates in this norm all the elements of a modern notion of conciliation also coherent with the European experience, underlines its poor application, due, according to her opinion, mainly to the insufficient integration of the aim of conciliation in the most recent evolution of Italian labour law.
