Abstract
The art. n. 1, Act. n. 142/2001 (as amended by the art. 9, Act. n. 30/2003), provides cooperative societies have with their own cooperative-workers not only a social relation, but also a "further" employeremployee relationship, and the art. n. 5, Act. n. 142/2001, provides cooperative societies, by a bill of exclusion, can break off also the employeremployee relationship with cooperative-workers (without a dismissal bill). The aims of this essay are to identify the court the cooperative-workers could apply to start legal proceedings against the exclusion bill and to study the effects of a judicial declaration of illegitimate expulsion from society on the employer-employee relation.
