Abstract

The author considers the criticism given by Luigi Mariucci towards the sitaution of labour law in the late '90s, assuming that the current crisis may originate, as well as from a difficult historical and social context, from an inadequate care of legal scholars for the problems of the building of labour law as law, and from an excess of faith in the automatic coincidence between labour law at a certain stage of its development and history in a generale sense; a coincidence that is put in a serious crisis, at the moment, by the superpower of economy on a global scale.
