Abstract
The proposal of Directive of 18 July 1997, concerning the Statute of European Company, is the starting point, used by the article, to analyse the workers' participation in European Community, especially from the point of view of law sources. It is also examined the Directive 94/45/CE about the creation of European Works Councils or information and consultation rights for workers employed in Community-scale undertakings or groups of undertakings. The author underlines that the European legislator uses more than before sources with a strong feature of flexibility (directives, collective agreements). This is an effort to come to a regulation of the subject, by which the role of collective agreements for regulation of participation models prevails.
