Abstract

The Author underlines the difficulties of enacting "social rights" in the European legal order. These difficulties spring from many different sources. Even in several domestic legal systems one can appreciate difficulties and incertitude as regard social rights and the proposal to enact them in sort of "European Constitution" is facing different approaches by different actors. The European institutions themselves are tackling many problems in guidelines in elaborating harmonisation and in establishing social policies for the Union, also because the European social model has became more uncertain then it was and it is still going on the research of a new model of Welfare State.
