Abstract
The fundamental Ue principles have integrated and inspired the German labour law: this is true in first place for the principle of equality and for the individual freedoms. As far as the fundamental collective and social rights are concerned, on the other hand, there is an uncertain situation: it is still to be understood to what extent these rights can be set up against the Ue legislation on concurrence and in which way they can eventually be derogated. The request to create a European fundamental rights catalogue can be justified with the necessity of a clarification as well as with the need of both an increased certainty of law and an improved effectiveness of the constitutional principles already sanctioned.
