Abstract
The essay takes first into consideration the cases of privatisation of public services to which the discipline on transfer of undertakings can be applied. The problem of the maintenance of the employment relationship with the transferee and that of the safeguard of the employees' rights are then analysed. A particular attention is reserved to the question of the application by the transferee of a new collective agreement on terms less favourable for the employees than that applied by the transferor. The essay, finally, analyses the perspectives offered by the bill now under discussion, which replaces the few but certain guarantees of the present day discipline on transfer of undertakings with new but still vague and uncertain guarantees.
