Abstract

The Author outlines in first place the difficult process of institutional reform in Italy up to the enactment of the new V title of the Italian Constitution (Act no. 1 of 2001). This is, however, a partial and incomplete reform. In particular it is not clear which is the distribution of competence in the legislative jurisdiction between the State and the Regions. In this contest we have to think to labour law: the problem is to match national labour law with both the EU regulations and the need to distinguish in a reliable way fair differences from the unfair ones, even on a local basis, in the labour law policies.
