Abstract
The paper examines some questions relating to mobbing, meant in its legal dimension and not in the usual sociological one. The author argues that mobbing's legal essential features are two at least: on one hand, the mobbing behaviour - that can be acted in a polymorphous way - has to be deliberate; on the other hand, it has to be reiterated. These features allow to unify and sanction as well as a breach of contract, between employer and employee, mobber's behaviours, although - one by one considered - those aren't a typical pattern of breach of contract. However, the author underlines the importance to consider mobbing as a typical kind of organisational problem and non only as an individual one.
