Abstract
This study aims at analyzing the mechanisms that different legal guardianship offer to protect the sick worker: at the international level, making a comparison between the right of the Ilo and the Eu, as in both Spanish and Italian law. The comparison shows that, depending on the features found in each of these systems, protection is articulated just considering disease as a cause of prohibited discrimination or as a manifestation of the constitutional right to health of workers.
