Abstract
The essay deals with the techniques of regulation of the collective bargaining system. In particular, the analysis focuses on two different themes: a) the dichotomy between the regulatory trends, about decentralized bargaining, in the heteronomous and autonomous sources; b) the lack of binding force of the autonomous sources of regulation of the collective bargaining system. In the last part of the essay, the Author analyzes the most recent autonomous regulation of the contractual pluralism (emerging from the "Testo Unico sulla Rappresentanza", signed on January 10, 2014), proposing some reflections about the possibility of a legislative intervention in trade union matters, according to the models of regulation typical of reflexive law.
