The principle of conditionality and the worker activation between the protection of social rights and the control of legality

Abstract

Beyond the objective of promoting the integration of unemployed workers into labour market, the conditionality principle can be a remedy to prevent social security frauds in cases where there is a lack of conditions for receiving subsidies. Since 2012 there is a clear enhancement of this principle as main instrument to implement the activation of workers; but, the conditionality is one of possible tools, but not the only one in order to facilitate the link between active and passive labour market policies. This model, however, has critical issues, especially in view of its potential impact on social rights, taking into account that the strengthening of conditionality is not balanced by the establishment of remedies to ensure the right to the service of job placement.
