Abstract
In the essay, the author first deals with the controversial question of the holder of the right to strike, discussing the thesis that entitles Unions, through the qualification of the collective interest to declare the strike as an exclusive Unions' interest. As far as essential public services are concerned, the author critically analyzes the thesis that would limit the legitimacy to the proclamation of the strike only to representative unions, as well as the proposal to recognize as legitimate only those strikes on which the consent of the majority of workers involved converge.
