Abstract
The research takes into consideration the Italian and the EC legal system with particular reference to agricultural and the food legislation. And it is completed concerning the problems related to the same topics in the agricultural and food international agreements. The present development of the "lex mercatoria privatorum", which actually never stopped even in the period of prevalence of state based commercial law, received a substantial boost from the increase of international trade. It has created a "soft law" system of rules and sanctions concerning particularly the trade of agricultural products and foodstuffs. The European Community also produces itself "soft law" and at this source are related many of the Agreements attached to the Marrakech Treaty.
