Abstract

The meaning of horizontal subsidiarity (art.118.4, Cost.) changes depending on the other constitutional provisions that are taken into account. The interpretation that connects the aforementioned principle with economic freedom (art.42, Cost.) assumes that art.118.4 strengthens the limits to the economic activity of the State. The interpretation that connects the horizontal subsidiarity with art.2 Cost., calls for a legislation that foster active citizenship. This last interpretation is convincingly argued by Giorgio Pastori.
