Abstract
The essay focuses on the popular legislative initiative of Region Emilia Romagna concerning physician-assisted suicide, meant to give effectiveness to the Constitutional Court’s ruling in the Cappato judgement (sentence n. 242/2019); as well as describing the followed procedure and the pronouncements of the Statutory Guarantee Consultation Board concerning the proposal’s eligibility and validity, the paper points out the possible criticalities of the initiative, either in terms of regional legislative competence and of a concrete right to death’s constitutionality.
