Tug-of-war between the Ligurian legislator, local authorities and judges in the recognition of the right to reception for beneficiaries of international protection

Abstract

This paper aims to frame the role played by Liguria in the reception of applicants and beneficiaries of international protection, outlining the most recent regional policies adopted by Regional Council and by some municipal resolutions. The outcome of this research traces, without any claim to exhaustiveness, the current identity of our Region with respect to the issue of integration and reception. The attention will also be shifted to the jurisprudential level, verifying how judges tend, sometimes to endorse stringent regulations in the name of public safety, and sometimes to safeguard the fundamental rights of the foreigner recognizing the value of integration and reception under the principle of constitutionally guaranteed solidarity. Often, in fact, the condition of the foreigner varies from region to region because of different political sensitivities, however, the providential intervention of jurisprudence allows the effectiveness of the right to reception.
