Abstract
The present paper aims to analyze the suspension of Regional Legislature member appointed Regional Executive member, provided by electoral laws of some Regions in which the two mentioned offices are mutually incompatible. Taking a cue from what recently occurred in Molise, the paper focuses particularly on the effects of such suspension on Regional government checks and balances, and on its compliance with the fundamental principles established by law no. 165/2004.
