Abstract

The authors are presenting the case of Bosnia and Herzegovina, a country that has constitutional court(s) and criminal law(s) that should preserve and protect legal order and at the same time, suffers from a practice of non-compliance with court decisions and obstruction in their application, and from failure of legal system in preventing or sanctioning non-compliance with court decisions, what authors argue in this paper through the analysis of practice of criminal courts in that country. The lack of political will and an ineffective prosecution system fail the judicial authorities to enforce court decisions, thus weakening the Rule of Law
