Abstract

The work provides some methodical indications to analyze the relationship between representative democracy and participation in rulemaking in comparative law. The author illustrates the reasons why the use of concepts such as participatory, direct, deliberative or administrative democracy could be misleading, due to the different way of understanding the role of participation in the jurisdictions. The work then underlines the relevant problem of the influence of the sources of law and case law on the effectiveness of participation models.
