The American model between systemic crisis and possible innovations
Abstract
The author deals with the relationship between participatory and representative democracy in the American experience and reconstructs the main problems related to public participation in rulemaking. The work shows as the American legal thinking is attempting to the remodulation the relations with representative democracy, to return to more formal regulatory procedures and rethinking the deferential role of the Congress and Judiciary.
