Abstract

China enacted the PIPL in 2021 to improve the protection of personal information. Article 13 of the PIPL sets out the legal bases for processing personal information, not only on the basis of the data subject’s consent, but also in cases of reasonable use, where the processing of personal information is permitted without the data subject’s consent. In judicial practice, the Beijing Internet Court has created the new circumstances for the reasonable use of personal information through a specific case trial. This has had an important impact on subsequent judicial practice and legislation to improve the reasonable use of personal information.
