Abstract

Contractual joint venture is a valid alternative to organization structure of company for a single business enterprise. This paper, after a few general guidelines for the description of the model joint venture, aims to analyze the relative success of the contractual form not a company in the Italian system, with regard, in particular, to its development and consequential claim untile the comprehensive rules contained in the final regulation of reference, represented by the Public Contracts Code of 2006. This text, in truth, reaffirms the fundamental features that characterize the institution in question qualified as a temporary association of companies, starting with the first legislation introduced in 1977 and consist of the absence of a new legal entity between the undertakings within, from a collective mandate and given special access to one of them, with correlative liability.
