Abstract
This essay aims to reconstruct the contractual model of establishment of State, which is present at an embryonic stage in Hugo Grotius’ De Jure praedae (1604-1608). In doing so, it will give particular emphasis to the anthropological assumptions of this contractual doctrine, taking due account of the strong influence that Calvinist theological voluntarism still had on the young author at the time when he wrote this commentary on the right of prey.
