Abstract

The essay sheds light on the Sistema Toscana foundation, established by law of the Tuscan region no. 61/2018, for the promotion of cultural heritage and activities. The aim of the study is to investigate the legal nature of this body, as well as to establish the legitimacy of the in-house foundation model, also in the light of recent Supreme Court case law, and whether this model makes it possible to ensure public control and, at the same time, to take advantage of the private form in terms of flexibility and ability to attract new capital.
