Abstract

The essay comments the sentence of the "Adunanza plenaria" of the Council of State nr. 5/2023 on constraints of relational cultural interest on historic venues and the consequent rules of use. It does not agree with the identification of three opposing jurisprudential guidelines and it’s aimed at showing the presence of a consolidated orientation which has established the legitimacy of such constraints and the consequent prohibition of changing the historic use of constrained assets if it is demonstrated the incorporation of protected intangible values in tangible assets subject to restrictions. The commented sentence confirms this consolidated orientation, validating it innovatively also in the light of article 7-bis of the Code of cultural heritage and landscape.
