To borders of cultural heritage between commonplaces and processes of production of culture
Abstract
The essay analyzes the legal concepts of culture, goods and cultural heritage. In particular it analyzes the concepts of promotion and protection of cultural heritage according to the Article 9 of the Italian Constitution; the process of legal assimilation of design and contemporary art to cultural heritage; in critical terms, both the regulatory process that led to the promotional discipline of historic business premises and the dilatation of the concept of culture (including leisure activity and hobbies) accepted by statistical surveys and cultural economic studies. Finally, the essay it's in favour of the introduction of the concept of "cultural and creative enterprise" as a place of production not only of the material cultural heritage but also of cultural activities that, however, don't still receive definitive dignity or unitary discipline in the Code of Cultural Heritage and Landscape.
